The advertised price of an off-plan property may not equal the buyer’s total outlay. A document-based assessment combines the payment schedule, contractual indexation, credit costs, municipal tax, registration acts, separately charged brokerage, and expenses required to receive and occupy the unit.

For a broker advising buyers of Brazilian residential launches, this distinction matters before the proposal. The task is not to add a generic percentage. It is to sort amounts into confirmed, estimated and unknown categories, then show when each one could affect the buyer’s cash position.

Key takeaways

A listing alone cannot establish the total cost of an off-plan unit. The figure depends on the contract, payment dates, adjustment clause, municipality, state fee table, credit proposal and occupancy choices. Until the relevant record supports missing information, it remains unknown.

  • The contract and summary chart should identify the total price, down payment, installments, due dates, adjustment index and any brokerage transferred to the buyer.
  • The National Construction Cost Index, or INCC, tracks construction-cost movements within its published scope. It is not automatically a measure of property appreciation or interest.
  • Credit offers should be compared through the disclosed Total Effective Cost, or CET. Expenses outside the credit operation stay separate.
  • ITBI is municipal. Notarial and registration fees follow state or Federal District rules, so neither has one defensible national percentage.
  • A preliminary credit assessment is not effective approval. An unsupported credit amount is unknown, not zero and not guaranteed.

That distinction can determine whether a proposal is financially viable.

What does total cost mean for an off-plan property?

Total cost is the documented sum paid for one unit over a declared period, such as signing to handover, registration or move-in. Change the endpoint and the result changes too. Every cost presentation must therefore name its time horizon, included components and unresolved amounts.

Total expenditure equals the down payment, installments, intermediate payments, contractual adjustments, credit charges, taxes, fees, separately paid brokerage and occupancy costs, less effective discounts.

This is a calculation method, not a quotation. Each component must be recorded in Brazilian reais for one unit and the selected period, with cents retained by line and in the total. If evidence is unavailable, the entry should read “not estimated.” It must never be entered as zero.

Contract disclosure is governed by Law 4,591 of December 16, 1964 and Law 13,786 of December 27, 2018. Both sources were accessed on September 14, 2026. Their application, including the interpretation of individual clauses, requires legal review.

A broker can begin by reading the developer’s sales table, then reconcile that table with the contract and summary chart.

Which payments can arise before delivery?

Before delivery, the buyer’s schedule may include a down payment, monthly installments, intermediate payments and a balance due at handover or financing transfer. Whether those obligations exist, when they mature and how they are adjusted are all contract-specific. The quoted price is not a promise of fixed cash flow.

For every obligation, record:

  1. base amount and due date;
  2. whether adjustment applies;
  3. contracted index and base date;
  4. payment or calculation date;
  5. supporting clause or statement.

Why does this ledger matter? It can expose a concentration of cash needs at handover, when the remaining balance, tax, registration acts and occupancy purchases may fall close together. That clustering is only a possibility until the documents and dates for the individual transaction have been reviewed.

How can INCC alter installments and the outstanding balance?

Within the scope published by Fundação Getulio Vargas’s Brazilian Institute of Economics, known as FGV IBRE, INCC measures changes in residential construction costs. It adjusts an obligation only if the contract calls for that application. The indicator does not automatically measure appreciation, interest or the exact cost of a particular project.

FGV IBRE publishes INCC-10, INCC-M and INCC-DI, each with a different collection window. The institutional indicator covers seven capitals. For a reproducible calculation, the record must preserve the precise series, contractual base date, lag and any replacement-index clause.

For each adjustable obligation, multiply the base amount by the index number on the calculation date divided by the index number on the contractual base date. The increase is the adjusted amount minus the base amount.

Apply the formula in reais to each installment or balance subject to adjustment, covering the interval from its base date to payment or calculation. Unless the contract specifies another method, round currency to cents only at the end.

An unavailable index or an off-schedule payment should not be filled with an assumption. Apply the contractual rule or block the calculation. There is no reliable national percentage for the final INCC effect: the outcome depends on the adjustable balance, dates, amortizations, payment schedule and construction period. This conclusion is a mathematical inference, not a national market estimate.

Why should financing proposals be compared through CET?

CET is the annual total effective cost disclosed for a credit operation. Under the applicable Central Bank of Brazil framework, it reflects cash flows associated with interest, fees, taxes, insurance and other expenses linked to that operation. A nominal rate alone reveals less.

Compare both the annual CET and the payment flows in each institution’s proposal. Do not rebuild the total credit cost from advertised interest alone. Keep the precision shown in the lender’s statement, rounding only for presentation.

But CET may omit costs outside the credit operation. ITBI, registration, finishes, moving and condominium expenses should remain separate unless the institution expressly includes them. This classification is an inference and needs confirmation against the individual disclosure.

Credit availability is another unresolved variable until approval is effectively granted. If the approved amount is lower than the balance due, the buyer must cover the shortfall. See Brazilian mortgage financing in 2026 for related credit context.

Are ITBI and registration included in the advertised price?

Inclusion cannot be assumed. ITBI is a municipal tax, whereas notarial and registration fees follow state or Federal District rules and vary by the applicable act and value bracket. Both calculations require current local sources and the transaction’s exact documents.

Article 156, II, of Brazil’s Federal Constitution assigns ITBI authority to municipalities. It sets neither a national rate nor a nationwide procedure. The applicable municipal law and official portal must be checked for the rate, taxable event, benefits, due date and filing process.

In Repetitive Theme 1,113, decided on March 9, 2022, Brazil’s Superior Court of Justice stated that the ITBI base is the property’s value under normal market conditions. It also held that the declared value has a relative presumption and that a municipality cannot impose a prior unilateral reference value. Applying the precedent to an individual transaction still requires tax review. See the official STJ repetitive-themes database, accessed September 14, 2026.

Registration is not the same as a deed or financing instrument. Under articles 1,227 and 1,245 of the Brazilian Civil Code, ownership transferred between living persons is acquired through registration of the title with the Real Estate Registry.

No single national percentage applies to notarial and registration fees. Law 10,169 of December 29, 2000 establishes general rules under which states and the Federal District set those charges. Determining the amount requires the current local table and identification of every applicable act. Related sources include the Public Records Law and, when relevant, Law 9,514 on fiduciary transfer. Can brokerage and construction-period charges appear separately?

Brokerage may be transferred to the buyer if the total price is disclosed in advance and the commission is separately identified. In Repetitive Theme 938, the Superior Court of Justice considered SATI, or a similar advisory service, abusive. Whether the precedent applies still depends on the facts and contract.

Its fit with the transaction, limitation periods and clause wording call for legal analysis. The decision was issued on August 24, 2016. Source: official STJ repetitive-themes database, accessed September 14, 2026.

Labels such as “construction interest” and “work progress charge” do not describe a universal levy. Without the banking contract, progress schedule and statements, their existence, calculation base, duration and composition remain unknown. Requesting those records is the defensible course; applying a market percentage is not.

What costs can arise at handover and move-in?

Condominium fees, IPTU, utility connections, inspections, finishes, cabinetry, lighting, moving and adaptations can all affect occupancy cash. Their actual incidence and amount remain unknown until the contract, technical specifications, condominium documents, municipal rules and local quotations are reviewed.

Technical specifications establish what the developer must deliver and what the buyer must purchase. A model unit, rendering or salesperson’s statement cannot replace that record.

Cash needed at handover equals the balance due, ITBI, registration acts, confirmed external fees and occupancy costs, less effectively approved credit and the buyer’s funds already reserved.

Record every term in reais for one transaction at the expected transfer date, retaining cents. The unit of analysis is one operation. Without effective approval, credit remains unknown. For process context, consult the guide to off-plan assignment and costs, while recognizing that assignment and an ordinary mortgage transfer involve different decisions.

What should a broker verify before recommending a proposal?

A broker should recommend progress only after converting the listing into a dated evidence file. At minimum, the review must cover the contract, payment schedule, adjustment rule, technical specifications, credit documents, local tax rules, state fee table and occupancy estimates supported by identified sources.

The file should include:

  • contract and summary chart;
  • complete payment schedule and adjustment clause;
  • exact INCC series, base date, lag and replacement rule;
  • technical specifications;
  • lender proposal, CET statement and effective credit approval;
  • municipal ITBI and IPTU rules;
  • current state fee table and applicable registry acts;
  • local quotations for connections, finishes and moving;
  • legal review of brokerage, SATI, cancellation, delivery, possession, condominium and tax clauses.

Classify each line as confirmed, estimated from an identified source, or not estimated. Show signing-to-handover and signing-to-move-in totals separately. The exercise does not eliminate uncertainty. It makes the consequence visible: the buyer can see which amounts are documented, which rest on disclosed estimates and which gaps still prevent a defensible recommendation.

FAQ

How do I calculate the total cost of an off-plan property in Brazil?

Calculate the total cost by adding the down payment, installments, contractually indexed adjustments, credit charges, applicable taxes, registration fees, separately disclosed brokerage, and confirmed occupancy expenses. Use the contract, payment schedule, credit proposal, municipal rules, state fee table, and local quotations. Record every undocumented component as unknown, not zero.

What costs are included when buying an off-plan property?

An off-plan purchase may involve the advertised price, contractual indexation, financing costs, ITBI, registration acts, separately charged brokerage, and delivery or occupancy expenses. The exact components depend on the contract and transaction. The incorporation contract and summary chart should disclose material payment terms, while variable costs require separate documentary verification.

How does the payment schedule for an off-plan apartment work?

The payment schedule typically identifies the deposit, monthly installments, intermediate payments, and any balance due at delivery or financing. Each obligation must be checked against its due date and contractual adjustment clause. A broker should map the buyer’s cash requirements through the declared horizon without assuming that future financing will be approved.

How is the final price of an off-plan property calculated after INCC adjustments?

The final adjusted amount must be calculated obligation by obligation using the index series, base date, adjustment period, and substitution rules stated in the contract. INCC tracks changes in residential construction costs, but it is not automatically property appreciation or interest. No reliable nationwide percentage can replace a documented calculation.

What is a construction progress fee on an off-plan property?

A construction progress fee is not a universal charge for every off-plan purchase. Its existence, calculation basis, duration, and composition depend on the financing structure and transaction documents. Before including it in the total cost, verify the bank contract, progress statements, and cost disclosures instead of applying a market average or generic percentage.

Is calculating every additional cost worthwhile before recommending an offer?

A documented total-cost analysis is worthwhile because it exposes cash needs that the advertised price alone cannot show. It helps the broker test affordability before the proposal, distinguish confirmed amounts from estimates, and avoid treating missing costs as zero. This reduces the risk of a financing shortfall at delivery, registration, or occupancy.

Can the same percentage estimate be used for every off-plan property in Brazil?

A single percentage cannot reliably estimate every off-plan purchase in Brazil. Contractual indexation depends on the payment flow, ITBI follows municipal law, registry fees follow current state or district tables, and occupancy costs vary locally. Apply one documented method across cases, but use the specific contract, jurisdiction, financing proposal, and quotations for each unit.
